Agreement to Terms

By accessing or using the FEED Platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

Eligibility

To use our Platform, you must be at least 18 years old and represent an eligible organization (restaurant, cafe, caterer, shelter, senior center, food bank, or similar organization). You must have the authority to bind your organization to these Terms.

User Accounts

When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Food Safety and Quality

For Donors:

  • You certify that all donated food meets applicable food safety standards
  • You accurately represent the quantity, type, and freshness of food items
  • You comply with all local, state, and federal food donation regulations
  • You maintain proper food handling and storage practices

For Recipients:

  • You accept responsibility for inspecting food upon receipt
  • You maintain proper food handling and storage after pickup
  • You distribute food according to applicable regulations

Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Misrepresent your identity or organization
  • Post false or misleading information about food items
  • Interfere with the Platform's operation or security
  • Attempt to access other users' accounts
  • Use the Platform for commercial purposes outside its intended use

Limitation of Liability

FEED Platform provides a connection service between food donors and recipients. We are not responsible for the quality, safety, or condition of donated food. To the maximum extent permitted by law, FEED Platform and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Good Samaritan Food Donation Act

Food donations made through our Platform may be protected under the Bill Emerson Good Samaritan Food Donation Act (42 U.S.C. 1791), which provides liability protections for good faith food donations to nonprofit organizations. Donors should familiarize themselves with applicable federal and state food donation laws.

Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time through your account settings.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
